Terms of Service
Last updated:
These Terms of Service (“Terms”) are an agreement between you and Xenett Mail (“Xenett”, “we”, “us”). They govern your use of Xenett Mail: the Xenett Mail web app, the Xenett Mail apps for iOS and Android, and the optional Xenett Mail extension for Google Chrome (together, the “Service”). Our Privacy Policy explains how we handle your information and forms part of these Terms.
By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization. If you do not agree, do not use the Service.
1. The Service
Xenett Mail is an email and calendar app that works with the Gmail and Microsoft Outlook accounts you already have. It lets you read, search, write, send and organize email; schedule emails and set reminders; view and manage your calendar; and, if you choose, use AI writing features and create Zoom meetings. Xenett Mail is not an email provider: your email, calendar and contacts continue to live in your Google or Microsoft account.
The Service is under active development. We may add, change or remove features, and some features may be offered as early-access or beta features that are less reliable than the rest of the Service.
2. Your account
- You must be at least 16 years old, or older if the law where you live requires it, to use the Service.
- You sign in with a Google or Microsoft account. Keep that account secure; you are responsible for activity that happens through your Xenett Mail account.
- Tell us promptly at logins@xenett.com if you believe someone has used your account without permission.
3. Connecting your accounts
When you connect an email account, a calendar or a Zoom account, you authorize us to access it and to act in it on your instructions, within the permissions you grant on the provider’s consent screen. For example, when you send, archive, label, snooze, delete or schedule an email, or create or change a calendar event, we carry out that action in your account for you.
- Connect only accounts you are entitled to use. If an account belongs to your employer or another organization, make sure its rules allow you to use it with the Service.
- Features such as undo send, scheduled send, reminders and notifications depend on our servers and on your provider, and may occasionally be delayed or fail. Check anything time-critical in your provider’s own app.
- You can disconnect an account at any time from the Service, or revoke our access from your Google, Microsoft or Zoom account settings.
4. Your content
Your emails, attachments, calendar events, contacts and anything else you create or connect (“your content”) remain yours. You give us a limited permission to access, store, copy, process, transmit and display your content only as needed to provide the Service to you, as described in our Privacy Policy. This permission ends when your content is deleted from the Service, except for copies we must keep by law or that are in backups awaiting deletion.
You are responsible for your content and for the emails you send using the Service.
5. AI features
- AI features are optional and run only when you use them. You can turn the AI assistant off in Settings.
- AI output is generated automatically. It can be inaccurate, incomplete or inappropriate, and it may not reflect your intent. Review it before you send or rely on it; you are responsible for what you send.
- To produce output, we send the relevant text to our AI providers, as described in our Privacy Policy.
- Daily usage limits apply to AI features, and we may change them to keep the Service available to everyone.
6. Acceptable use
You agree not to use the Service to:
- send spam, unsolicited bulk email or messages that break anti-spam laws;
- send phishing messages, malware or other harmful code;
- send or store content that is unlawful, harassing, defamatory or fraudulent, or that infringes anyone’s rights;
- access any account or data you are not authorized to access;
- interfere with or disrupt the Service, overload it, or get around its security, rate limits or usage limits;
- copy, decompile or reverse engineer the Service, except where the law allows it despite this restriction;
- access the Service by automated means other than the apps we provide; or
- break the law, or the terms and policies of Google, Microsoft or any other service you connect.
7. Third-party services
The Service works with services run by others, including Google, Microsoft and Zoom, and relies on providers such as Supabase, Amazon Web Services and our AI providers. Your use of a third-party service is governed by that service’s own terms and privacy policy. We are not responsible for third-party services, and the Service may be affected if a provider changes, limits or stops its service or our access to it.
If you download a Xenett Mail app from the Apple App Store or Google Play, the terms of that store also apply. [APP STORE TERMS, IF A CUSTOM END-USER LICENSE AGREEMENT IS USED.]
8. Fees
The Service is currently provided free of charge. If we introduce paid features, we will tell you in advance and you will not be charged unless you agree to pay. [PRICING AND PAYMENT TERMS, IF ANY.]
9. Feedback and problem reports
If you send us feedback or suggestions, we may use them without any obligation to you. Problem reports you send from the app are handled as described in our Privacy Policy.
10. Our intellectual property
The Service, including its software, design and the Xenett name and logos, belongs to us or our licensors. Subject to these Terms, we give you a personal, non-exclusive, non-transferable and revocable license to use the Service, and to install our apps and extension on devices you control, for as long as you have an account. We reserve all rights not expressly granted.
11. Suspension and termination
- You can stop using the Service at any time. You can disconnect your accounts or sign out in the app, and ask us to delete your account at logins@xenett.com.
- We may suspend or end your access if you break these Terms, if your use creates a security or legal risk, or if we are required to by law. Where reasonable, we will tell you first and give you a chance to fix the problem.
- We may stop offering the Service. If we do, we will give you reasonable notice where we can.
When your access ends, your right to use the Service ends too, and we handle your information as described in our Privacy Policy. Sections 4, 9, 10 and 12 to 17 continue to apply after termination.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, secure or error-free, that every email will be synced, delivered or sent on time, or that AI output will be accurate. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Service or these Terms. Our total liability for all claims relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim and [LIABILITY CAP AMOUNT].
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, or any rights you have as a consumer that cannot be waived.
14. Indemnity
To the extent permitted by law, you will indemnify us against claims, losses and costs (including reasonable legal fees) arising from your content, your use of the Service in breach of these Terms, or your breach of the law or of anyone else’s rights.
15. Governing law and disputes
These Terms are governed by the laws of [GOVERNING LAW / JURISDICTION], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [GOVERNING LAW / JURISDICTION], unless the law where you live gives you the right to bring a claim elsewhere. [DISPUTE RESOLUTION PROCESS, IF ANY.]
16. Changes to these Terms
We may update these Terms. We will post the new version on this page and update the “Last updated” date. If a change is material, we will tell you in the app or by email before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms; if you do not agree, stop using the Service.
17. General
- These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
- If a provision is found unenforceable, the rest of these Terms stays in effect. Not enforcing a provision is not a waiver of it.
- You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets, subject to our Privacy Policy.
- We are not liable for delays or failures caused by events beyond our control.
